The Regulations define general conditions, rules and manner of using the Vanity Nap online store run by VANITY NAP PAULINA MROCZYŃSKA, with headquarters in Warszawa (01-793), at ul. Rydygiera 8 budynek 19, NIP: 5862252096, REGON: 363388879.

 

1. DEFINITIONS

 

1.1. Whenever these regulations refer to:

 

1.1.1. Working Days - this is understood as the days of the week from Monday to Friday, excluding public holidays.

 

1.1.2. Delivery - shall mean delivery to the Customer of the Goods specified in the Order via the Supplier,

 

1.1.3. Suppliers - this is understood as the courier company indicated by Vanity Nap on the Website.

 

1.1.4. Password - it means an individual string of letters, digits or other characters securing access to the Customer Account.

 

1.1.5. Customer - shall be understood as a Consumer or Entrepreneur, for the benefit of whom, according to the Regulations, services may be provided electronically or with which a Sales Agreement may be concluded.

 

1.1.6. Consumer - means a natural person having full legal capacity who performs a legal action not related directly to his business or professional activity.

1.1.7. Customer Account - this is understood as the functionality of the Website, launched by Vanity Nap for the Customer after the Customer has made the Registration.

 

1.1.8. Login - it means an individual Customer identification, required together with the Password to log in to the Customer Account. The login is the correct email address of the Customer.

 

1.1.9. Entrepreneurs - it means a natural person, a legal person or an organizational unit that is not a legal person, which the law provides for legal capacity, conducting business or professional activity on its own behalf.

 

1.1.10. Regulations - this is understood as these regulations.

 

1.1.11. Registration - it means a procedure defined in the Regulations, the fulfillment of which is required for the Client to use all the functionalities of the Website.

 

1.1.12. Vanity Nap - this is understood as VANITY NAP PAULINA MROCZYŃSKA with headquarters in Warszawa (01-793), at ul. Rydygiera 8 budynek 19, NIP: 5862252096, REGON: 363388879.

 

1.1.13. Shop - it means the online store Vanity Nap, run by VANITY NAP PAULINA MROCZYŃSKA  on the Website

 

1.1.14. Website - it means a website maintained by VANITY NAP PAULINA MROCZYŃSKA  at www.vanitynap.com

 

1.1.15. Commodity - it means a product offered by Vanity Nap through the Store.

 

1.1.16. Sale Agreement - it means a sales agreement concluded remotely by electronic means of communication made available on the Website, concluded between Vanity Nap and the Customer.

 

1.1.17. Consumer Rights Act - it means the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827, as amended).

 

1.1.18. Ordering - this is understood as an offer to conclude a Vanity Nap folded Sale Agreement by the Customer via the Store.

 

2. GENERAL PROVISIONS

 

2.1. The correct use of all functionalities of the Website by the Customer is possible only with the help of a device allowing the Customer to access the Internet under the following technical requirements:

 

2.1.1. screen resolution: 1024x768 or higher;

2.1.2. color depth: 32 bits or higher;

2.1.3. Internet browsers: Internet Explorer 10, Firefox 3.5, Google Chrome 10, Opera 10.5, Safari 5.1 or newer versions;

2.1.4. enabled cookies;

2.1.5. Javascript enabled.

 

2.2. It is forbidden for the Client to take any actions that are not explicitly permitted by the Regulations, in particular any activities that would destabilize the work of the Website and the Store, hinder access to them for other customers or hinder the use of the Website and the Store.

 

2.3. It is forbidden for Clients to take all actions prohibited by law to the detriment of Vanity Nap or other Clients, as well as jeopardizing their rights or interests.

 

2.4. It is forbidden to send by the Customer within the Website and the Shop spam and unsolicited commercial information, as well as commercial, advertising and promotional activities without the explicit consent of Vanity Nap.

 

2.5. It is forbidden to use worms, bots, viruses and any other computer codes, files or programs that would destabilize the work of the Website or the Store, or expose or threaten the interests of Vanity Nap or other Customers within the Website and the Shop.

 

2.6. The Parties may have breaks in the activities of the Parties, during which the Customer temporarily will not be able to use its functionality, due to for maintenance, alterations or improvements, the Website. Van Nap will, as far as possible, inform about these breaks on the Website in good time.

 

2.7. Vanity Nap makes every effort to ensure maximum security while using the Website and the Store, however using them, like using any other websites, may be at risk of getting malicious software into the IT system and the Client's device as well as unauthorized access to his data. In order to minimize these risks, the Customer should use appropriate technical security measures, including in particular the use of appropriate anti-virus software and protecting Customer's identification in the Internet.

 

2.8. Vanity Nap as part of the Website provides the following services to Clients by electronic means:

 

2.8.1. enabling the creation of a Customer Account;

2.8.2. sending ordered commercial information regarding the Goods;

2.8.3. enabling the conclusion of a Sales Agreement in the Store.

 

2.9. Vanity Nap reserves the right to display advertisements on the offered Goods as well as goods and services of third parties on the Website.

 

2.10. The Customer is entitled to use the Site only for his own use. It is not permissible to use the resources and functions of the Website in order to conduct a commercial activity by the Client or which would infringe the interest of Vanity Nap.

 

2.11. Using the Vanity Nap Store means any activity of the Customer, which leads to the User getting acquainted with the digital content contained on the Website.

 

2.12. In order to place an Order in the Store and to use the services available on the Website, the Customer must have an active e-mail account.

 

3. REGISTRATION OF A CLIENT ACCOUNT

 

3.1. In order to create a Customer Account, the Customer is obliged to make a free Registration, however, Registration is not necessary for placing orders by Clients.

 

3.2. In order to register, the Customer should complete the registration form made available on the Website and send the completed registration form electronically in accordance with the functionality of the Website.

 

3.3. When completing the registration form, the Customer should keep the following rules:

 

3.3.1. fill out all fields of the registration form, unless the field is optional, but the information entered into the registration form should concern the customer and be true;

3.3.2. read and confirm the fact of reading the Regulations, marking the appropriate field of the registration form; there must be a separate checkbox

3.3.3. express the will to conclude a service contract by email from Vanity Nap regarding the Customer Account service; there must be a separate checkbox

3.3.4. authorize Vanity Nap to process his personal data included in the registration form in order to provide the Customer Account service and consent to Vanity Nap's forwarding to the email address provided by the Customer during registration of information related to technical maintenance of the Customer Account; there must be a separate checkbox

3.3.5. authorize Vanity Nap to process his personal data included in the registration form in order to place and execute the Order and consent to Vanity Nap's forwarding to the email address provided by the Customer during registration of information related to the implementation of the Order. there must be a separate checkbox

 

The fulfillment of the above-mentioned activities is voluntary, however failure to fulfill any of the above-mentioned obligations makes it impossible to register and set up a Customer Account as well as submit and execute the Order.

 

3.4. After sending the completed registration form, the Customer receives an email confirmation of the Registration by Vanity Nap. With this moment, the Customer gains access to the Customer Account and changes of data provided during the Registration of data (except for the Login) and gains the ability to use the other functionalities of the Website and the Store.

 

3.5. The Customer is obliged to make every effort to ensure that no password is made available to third parties. The customer is obliged to immediately notify Vanity Nap about the loss of the Password to unauthorized persons. In this situation, the Customer should immediately change the password, using the Customer Account functionalities.

 

4. SUBMISSION

 

4.1. The order in the Online Store is made using the form available on the Website 7 days a week, 24 hours a day.

 

4.2. Each of the Goods contains a detailed description of the item, along with the specified essential features, as well as the price.

 

4.3. In order to place an order, the Customer:

4.3.1. specifies the ordered Goods and their quantity;

4.3.2. it adds the Goods to the "basket" in accordance with the functionality of the Store;

4.3.3. determines the method of payment and Deliveries, with Vanity Nap accepting the following forms of Delivery and payment:

4.3.3.1. Payments: Pay Pal, delivery: courier indicated by the store

4.3.4. confirms the data, including specifying the Order and the delivery address;

4.3.5. approves the Order by clicking the "Order with payment obligation" button (there must be such a button).

4.3.6. After submitting the Order, Vanity Nap has the right to contact the Customer in order to verify the Customer's data, clarify the Order or inform about a possible lack of Goods. In particularly justified cases, in particular in case of doubts as to the accuracy of the Customer's data, Vanity Nap reserves the right to refuse to process the Order.

4.3.7. After placing the Order or after contacting the Customer in accordance with the provisions of the point above, the Customer will receive an order confirmation email along with the information required by Art. 12 para. 1 of the Act on consumer rights. The conclusion of the Sales Agreement takes place at the time of sending the Customer confirmation in accordance with the previous sentence.

4.3.8. Vanity Nap is obliged to provide the Customer with a product free from defects, unless these defects are clearly and sufficiently marked in the description of the Goods.

 

5. METHOD OF PAYMENT AND ORDER COMPLETION

 

5.1. All prices listed on the Website as part of the Store are given in Polish zlotys (PLN) and are gross prices.

 

5.2. Vanity Nap reserves the right to change the price of the Goods specified on the website, however the changes do not apply to Orders placed before the price change.

5.3. The given prices of the Goods do not include the cost of Delivery. Delivery costs are given on the Website in the TWÓJ KOSZYK bookmark and depend on the method of Delivery of the Goods and the selected Supplier chosen by the Customer.

5.4. Order completion date - understood as the date of preparation of the Order and its delivery to the Supplier, and if the Customer selects a Personal Order collection order for personal collection - it is from 3 to 5 working days from the date of posting the money on the Vanity Nap account.

5.5. Payment "in advance" can be made by the Customer only via Przelewy24.pl. The payment should be made within 3 business days from the date of confirmation of the Order. In the event that the deadline is exceeded by the Customer, Vanity Nap reserves the right to refuse to process the Order.

 

6. THE CONSUMER'S RIGHT TO WITHDRAW FROM THE AGREEMENT

 

6.1. The Customer who is a Consumer who concluded the Sale Agreement, may withdraw from it within 14 days without giving any reason.

6.2. The deadline to withdraw from the Agreement expires after 14 days from the date on which the consumer came into possession of the Good or in which a third party other than the Supplier I indicated by the consumer came into possession of the Good.

6.3. The right to withdraw from the contract is not entitled to the consumer in relation to the contract (pursuant to Article 38 of the Act of 30 May 2014 on consumer rights - unified text of 24 June 2014, Journal of Laws of 2014, item 827):

 

6.3.1. 1) for the provision of services, if Vanity Nap performed the full service with the express consent of the Consumer, who was informed before the beginning of the benefit that after fulfilling the provision by the entrepreneur will lose the right to withdraw from the contract;

6.3.2. 2) in which the object of the service is an item delivered in a sealed package, which after opening the packaging can not be returned due to health protection or hygiene reasons, if the packaging was opened after delivery;

6.3.3. 3) in which the object of the service are sound or visual recordings or computer programs delivered in a sealed package, if the packaging has been opened after delivery;

6.3.4. 4) for delivering newspapers, periodicals or magazines, with the exception of a subscription agreement;

6.3.5. 5) for delivery of digital content that is not stored on a tangible medium, if the fulfillment of the service started with the consumer's express consent before the deadline to withdraw from the contract and after informing the entrepreneur about the loss of the right to withdraw from the contract.

 

6.4. The Consumer may exercise the right to withdraw from the Sales Agreement by submitting an unambiguous statement in any form before the end of the withdrawal period in accordance with point 6.2. above. It may use for this purpose a form constituting an attachment to these Regulations.

6.5. In the event of withdrawal from the Sales Agreement, Vanity Nap will return the Consumer - immediately, but no later than within 14 days from the date of receipt of the declaration of willingness to withdraw from the Sales Agreement - all payment costs received from it, including the cost of delivering the Goods (except for additional costs resulting from the way chosen by the Consumer to deliver the Goods other than the cheapest way offered by Vanity Nap).

6.6. Returns will be made using the same method of payment as used by the Consumer, unless the Consumer has explicitly agreed to a different method of return, which does not involve any costs for him.

6.7. Vanity Nap may withhold reimbursement until receipt of the Product or delivery time by the Consumer of proof of its return, depending on which event occurs first.

6.8. In the event of withdrawal from the Purchase Agreement, the Consumer should return or deliver the Vanity Nap (to the address: Rydygiera 8, budynek 19, 01-793 Warsaw) immediately, at any time not later than 14 days from the day on which the Consumer informed The Seller about withdrawal from the Sales Agreement. The deadline is met if the Consumer sends back the Goods before the expiry of 14 days.

 

6.9. The consumer bears the direct cost of returning the Goods.

6.10. The consumer should deliver the Goods in such a way that they will not be destroyed.

6.11. The consumer is only liable for a decrease in the value of the Product resulting from the use of it in a different way than was necessary to establish the nature, characteristics and functioning of the Good.

 

7. WARRANTY FOR PHYSICAL AND LEGAL DEFECTS OF THE GOODS

 

7.1. Vanity Nap is responsible to the Customer who is a Consumer, if the product sold has a physical or legal defect (warranty).

7.2. A physical defect is the non-compliance of the Goods with the Sales Agreement. In particular, the Product is inconsistent with the Sales Agreement if:

 

7.2.1. does not have properties that this type of item should have due to the purpose in the Sales Agreement marked or resulting from the circumstances or destination;

7.2.2. does not have properties that Vanity Nap has provided to Customer, including a sample or pattern;

7.2.3. is not suitable for the purpose of which the Client informed Vanity Nap at the conclusion of the Sale Agreement, and Vanity Nap did not raise any objections to such a destination;

7.2.4. has been delivered to the Customer incomplete.

 

7.3. Vanity Nap liability under the statutory warranty is in the provisions of the Civil Code, in particular art. 556, 5561-5563 and art. 559-561 of the Civil Code.

7.4. If the Customer is an Entrepreneur, Vanity Nap's liability under the warranty is excluded.

7.5. The consumer has the right to lodge a complaint in the case of physical or legal defects of the delivered Goods.

7.6. The complaint should be sent in writing to Vanity Nap (Rydygiera 8, building 19, 01-793 Warsaw) along with the advertised Goods and justification or delivered personally to Vanity Nap.

7.7. Complaints are considered within 14 days from the date Vanity Nap receives the Goods being complained about. The Vanity Nap will inform the Consumer about the result of the complaint by the same route as the complaint, unless the Consumer reserves a different form of contact.

7.8. If the data or information provided in the complaint need to be supplemented, before considering the complaint Vanity Nap will ask the Consumer submitting the complaint to supplement it in the indicated scope. In this case, the 14-day period for considering the complaint will be counted from the date of supplementing this data or information.

 

8. PERSONAL INFORMATION

 

8.1. The administrator of Customers' personal data is Vanity Nap with its registered office in Warszawa (01-793), at ul. Rydygiera 8 budynek 19, 

NIP: 5862252096, REGON: 363388879.

 

8.2. The data will be processed in order to provide the Customer Account service and to fulfill the Order.

 

8.3. The customer has the right to access his personal data and to correct them. Providing personal data is voluntary, but failure to do so makes it impossible to set up a Customer Account, place an Order and conclude a Sales Agreement.

8.4. Orders can not be placed anonymously.

 

 

9. COOKIES

 

9.1. Vanity Nap does not collect any information automatically, except for information contained in cookies.

9.2. Cookies are IT data, in particular text files, which are stored on the end device of the User of the Website and are intended for the use of the Website. Cookies usually contain the name of the website from which they originate, their storage time on the end device and a unique number.

9.3. The entity placing cookies on the end device of the Website User and accessing them is Vanity Nap in Warsaw.

9.4. Cookies are used for the following purpose:

9.4.1. adjusting the content of websites to user preferences and optimizing the use of websites; in particular, these files allow to recognize the user's device of the website and properly display the website, tailored to his individual needs,

9.4.2. creating statistics that help to understand how website users use websites, which allows improving their structure and content,

9.4.3. maintaining the user session of the website (after logging in), thanks to which the user does not have to re-enter their login and password on each subpage of the website,

9.4.4. providing users with advertising content more tailored to their interests.

9.5. The Website uses the following types of cookies:

9.5.1. "necessary" cookies, enabling the use of services available as part of the website, e.g. authentication cookies used for services that require authentication on the site,

9.5.2. cookies used to ensure security, e.g. used to detect fraud in the field of authentication within the website,

9.5.3. cookies, enabling the collection of information on the use of website pages,

9.5.4. "functional" cookies, allowing "remembering" the settings selected by the user and personalizing the user interface, e.g. in the scope of the selected language or region from which the user comes, font size, website appearance, etc.,

9.5.5. "advertising" cookies, enabling users to provide advertising content more tailored to their interests.

 

9.6. In many cases, software used for browsing websites (web browser) allows cookies to be stored in the user's end device by default. Users can change their cookie settings at any time. These settings can be changed in particular in such a way as to block the automatic handling of cookies in the settings of the web browser or inform about their every posting in the user's device. Detailed information about the possibilities and ways of handling cookies are available in the software (web browser) settings.

9.7. Vanity Nap informs that restrictions on the use of cookies may affect some of the functionalities available on the Website.

 

10. FINAL PROVISIONS

 

10.1. The regulations are valid from the day of announcement.

10.2. Vanity Nap reserves the right to change the Regulations to the extent permitted by law. Any changes to the Regulations become effective within 14 days from the date of publication of changes on the Website. Orders placed before the date of amendments to the Regulations are implemented based on the content of the Regulations on the day of placing the Order.

10.3. In the event of a change or annulment of any of the provisions of the Regulations by a public authority or a court, its other provisions shall remain in force.

10.4. The law applicable to the Regulations is Polish law. All disputes will be considered by the competent local court.
